HOUSE OF REPRESENTATIVES

142nd GENERAL ASSEMBLY

HOUSE BILL NO. 15

AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO THE CLEAN INDOOR AIR ACT.

 

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 

Section 1.  Amend §2903, Chapter 29, Title 16, Delaware Code by striking paragraphs (13) and (27) of said section and by redesignating the remaining paragraphs of said section accordingly.

Section 2.  Amend §2904, Chapter 29, Title 16, Delaware Code by adding the following new paragraphs:

"(7)   Any licensed tavern or taproom as defined in Title 4 of this Code;

(8)      Up to fifty percent (50%) of the indoor enclosed area where wagering is permitted at a video lottery facility or at a harness or thoroughbred race track provided, however, that for such areas where smoking is permitted by reference to this subsection and not by reference to any other permitted exemption, there shall be a minimum of at least 10 air changes per hour with at least 5 of such changes through a ninety (90%) efficiency filter, media or electronic, followed by carbon filtration.

(9)      Any facility wherein a non-profit organization conducts activities that are licensed pursuant to Chapter 11, Title 28 of the Delaware Code, provided attendance at such activities is limited to persons 21 years of age or older.  This exemption shall only apply while such licensed activities are being conducted.  Any licensing requirement which would allow persons under age 21 to attend such activities is hereby repealed to the limited extent that would allow the licensee to restrict attendance to persons 21 years of age or older."


 

SYNOPSIS

This bill amends the Clean Indoor Air Act by permitting smoking in taverns, taprooms, horse racetracks, video lottery machine facilities, and non-profit bingo and charitable gambling facilities.
